Effective June 10, 2026, the USPTO eliminated the petition fee for its Streamlined Claim Set Pilot Program. Useful news — but let's be honest: the small-entity fee of $60 was not much of a barrier to entry. But the program's real barrier, the limited range of eligible applications, remains intact.

The trade-off: amend to (or file with) no more than one independent claim and ten total claims, no multiple dependents. In exchange, the application advances out of turn for an expedited first Office Action — faster, focused examiner engagement without Track One fees or requirements.

Who Benefits Most?

Patent applicants with an eligible pending case in a backlogged art unit who desire early engagement on claims covering key commercial features, or a fast allowance of claims covering a newly identified competitor product. The program provides a no-fee alternative for securing early allowance of strategically important subject matter.

Eligibility Requirements

The catch is program eligibility, which is narrow:

  • Original, non-continuing utility nonprovisional under 35 U.S.C. § 111(a), actual filing date before October 27, 2025 (already 8+ months old today).
  • Not a national stage entry; no priority claim to a prior U.S. nonprovisional or a PCT designating the U.S.
  • Petition (Form PTO/SB/472) filed before the first Office Action AND before assignment to an examiner.

That last point is the real deadline. Once your case is assigned to an examiner, the door closes — regardless of fee. If you have a qualifying application sitting in a backlogged TC, the window is now.

Availability is still wide open (per May 12, 2026 USPTO data): 158 petitions received, 76 granted, per-TC grants of 4–16 — well below the ~200 per-center cap.

Implications for AI-Related Applications

For AI-related applications, where § 101 and scope disputes routinely stretch pendency, narrowing to a single robust independent claim can produce a quicker allowance on more defensible ground, which can provide commercially valuable coverage that is less vulnerable in post-grant proceedings and litigation.
