A startling new report from MIT suggests that around 95% of enterprise generative-AI pilot projects deliver little to no measurable P&L impact.
Why should patent and IP professionals care? Because this data underscores a deeper truth about innovation and protection: It's not just what you build—it's how you scale it and protect it.
Initial patent strategy, like AI deployment, often focuses on the idea (the invention) and its filing (the formal protection). But what too few companies emphasize is the system behind it—the workflows, processes, governance, and strategy that turn invention into sustained value.
What the MIT Findings Teach Us About IP Strategy
Let your product development dictate your patent strategy. Just because a technology is "AI-enabled" doesn't guarantee economic or strategic value. Likewise, an early or quickly issued patent isn't enough if it no longer aligns with your product or business goals. File early, and update often as your product or strategy evolves.
Focus on the right use case and workflow. The report shows successful AI deployments are narrow, domain-specific, and integrated into existing operations (https://shorturl.at/0zEF8). Similarly, patent strategy isn't just about filing—it's about value creation and leverage for partnerships or licensing. Strong patents can fuel collaboration, and MIT data shows external partnerships succeed 67% of the time vs. 33% for internal builds.
Governance matters. Many AI projects fail because data is messy, roles undefined, metrics vague. In IP, poor governance leads to weak alignment, unclear ownership, and reactive filings.
A patent is only the start. Filing early helps, but without an ecosystem—licensing, enforcement, portfolio alignment—you risk stagnant IP, just as companies risk stalled AI pilots.
Patents Drive Higher Valuations
Robust patents can also drive higher valuations. A Harvard Business School study (https://shorturl.at/epFcO) found AI patents earn a 9% premium—about $3M more per patent—while VC data (https://shorturl.at/fLCqa) shows startups raising millions more thanks to strong IP portfolios that reduced investor risk and boosted multiples.
If your innovation is AI-driven, ask not only "Have I filed for protection?" but "Do I have the system and strategy to deploy it—and protect its return?"
