- Anchor claims in technical improvement: Eligibility under §101 requires a tangible enhancement to machine or system functionality, rather than abstract results or human-analogous performance.
- Craft a coherent technical narrative: Effective patent applications articulate technical problems, disclose new embodiments to solve them, and identify results showing tangible or synergistic improvements—for example, boosts in speed, cost, or accuracy.
- Avoid abstract idea rejections: Patent claims involving mathematical concepts—like "analyzing data" or "generating predictions"—should also recite a practical application of the analysis results.
- Adopt a holistic IP strategy: Patents are not always optimal. Trade secrets, copyright, and contractual protections may provide superior safeguarding for certain AI innovations, for example where patent protection is unavailable or infringement is difficult to detect.
In the current AI patent landscape, innovative applications of AI technology—enabled by sufficient technical disclosure, and covered by strategic patent claims—are more valuable than ever. Aligning these legal strategies across all phases of your AI-enabled product development is essential for defensible and enforceable intellectual property.
